Terms and Conditions

1. Introduction

These Terms and Conditions govern the use of the Vigour Health  (“Device”) and related mobile application (“App”). By using the Device or App, you agree to these Terms. If you do not agree, please discontinue use immediately.

2. Purpose of the Device

The Device is designed to promote health awareness by monitoring fitness and wellness indicators such as heart rate, steps, sleep patterns, and related activity data.

⚠️ Disclaimer: The Device is not a medical device and does not diagnose, treat, cure, or prevent any disease. It should not replace professional medical advice, diagnosis, or treatment. Always consult a licensed healthcare provider for medical concerns.

3. User Eligibility

The Device and App are intended for users 18 years and older. Use by minors should be supervised by a parent or guardian.

4. Data Collection & Privacy

• The Device and App collect data such as heart rate, activity levels, sleep, and personal details provided by the user.
• All personal information is processed in accordance with the Protection of Personal Information Act (POPIA), 2013 of South Africa.
• Your data will only be used to provide services, improve product features, and (if consented to) for research or promotional purposes.
• We do not sell your data to third parties. Data may be shared with authorized service providers or where legally required.

5. User Responsibilities

• Ensure the Device is used as intended and according to user guidelines.
• Do not rely solely on the Device for critical health decisions.
• Keep login details confidential and notify us of any unauthorized use of your account.

6. Warranty and Limitations

• The Device comes with a 12-month warranty against manufacturing defects under normal use.
• This warranty excludes damage caused by misuse, accidents, unauthorized repairs, or water exposure beyond specified limits.
• To the extent permitted by South African law, we are not liable for indirect, incidental, or consequential damages arising from the use or inability to use the Device.

7. Liability

• The Company will not be liable for any injury, loss, or damage resulting from reliance on the Device or App for medical purposes.
• Users accept full responsibility for their health and well-being when using the Device.

8. Updates & Modifications

We may update these Terms, the Device, or the App from time to time. Continued use of the Device or App after updates indicates acceptance of the revised Terms.

9. Governing Law

These Terms are governed by the laws of the Republic of South Africa, including the Consumer Protection Act (CPA) and POPIA.
